Election 2000 Message Board


MegaLaw received a tremendous amount of feedback regarding the Florida Supreme Court decision. Here were some of your thoughts.

"We have at least 5 incompetent Supreme Court Justices for the following reasons:
1. There was no equal protection under the law when some counties in Florida were provided with voting machines that could not verify the vote instantly. I voted in North Carolina electronically, and I knew whom I voted for President when I pushed the vote button. To use the same argument against a lack of recount standard was too little too late.
2. It is unheard of in jurisprudence, that a judge could issue a remedy and state that it was too late. This is as if in the case, when the conviction of a death roll inmate was found to be questionable by a higher court, and then for the judge to state that it was too late to pursue an overturn, since the inmate was going to be executed within 24 hours.
3. If the Justices of the US Supreme Count were not satisfied with the lack of a recount standard, why did'nt they say so in their opinion to the Florida Supreme Count in November. If this was an oversight of the Count, then they must provide time for a remedy.
4. I have question about a uniform recount standard as well. In local Jury trials, have there ever been a uniform standard for the Jury? I have seen lawyers try to manipulate the Jury selection process until they find the most sympathetic group. The Jury decision in one county could easily differ from that from another county, but we put people to death based on this system. Hence, a recount standard established by the local canvassing board is legal.
5. The US Supreme Court should have sent the case back to the Florida Supreme Court to establish some kind of an acceptable standard, and then let the recount proceed. Florida voters should elect the next President, and not the US Supreme Count! . Since Supreme Court Justices were chosen and nominated by the President and confirmed by the US Senate, how could these Justices reverse the process and pick a President? We have set a dangerous unconstitutional precedent."

"Can someone please tell me if something is legally amiss in the following:
Potential ballot standards for constituting a vote and determining voter intent:
1) chad completely punched out.
2) chad detached from at least 3 corners
3) chad detached from at least 2 corners
4) chad detached from at least 1 corner
5) chad dimpled or detached from at least 1 corner
At the time the Florida supreme court ruled to proceed with the hand-count of under-punched ballots, they could have ordered all counties to determine five seperate counts using the five different standards rather than having each county decide their own single standard. It would not have taken any longer because each ballot would still only need to be examined one time. If the same candidate would have won Florida regardless of the standard, it would be obvious he should win the election. If different candidates would have won depending on the standard, the U.S. Supreme Court would probably have been forced to choose the best standard to determine voter intent, but at least that standard would then have been consistant throughout Florida."

"They keep saying we will accept George Bush for president. The only way we are going to stop wanting a recount or accept anything he says is if he appoints Al Gore as Secretary of State or Attorney General, etc. That way both of them can run the country and would be the only appeasement to me. The Supreme Court set a dangerous precedent because they are bi-partisan. They can appoint those who appointed them. This should have been sent to the Senate which is how the law was written. This may be the beginning of a dynasty and our freedom to choose has been taken away. It shows money and power can manipulate anything."

"Justice Stevens had it right: less confidence in the fairness and objectivity of the Court in deciding issues according to LAW.
Justices Stevens and Ginsburg are the very indications that his statement of the Judge being the loser is correct in my opinion.
Every Justice at that time knew in their gut that the Democrats were cheating in counting and recounting when they needed more votes. In fact, 7 Justices decided that the hand counts in the haphazard way in which they were being done, and changed when sufficient votes were not forthcoming, was giving unequal treatment to not only the other voters in FL but throughout the U.S.
That kind of cheating no doubt (to me) goes on in the entire country througout every county and Parish, especially when the vote is close and hand counting by the party who has the majority in the Canvassing Boards can take these commonly machine rejected votes and make up votes from them. It is an obvious probability and you know it."

"I want to sent a message to Justice Stevens Thank you very much."

"what shame, what a lack of justice, what a disappointment to the basic security this country thought was hers. i hang my head to know that justice does not prevail. George W Bush will deal with the peoples justice. he will be shunned and shamed by accepting such a win. to be told by the supreme court of America that there isn't enough time to get to the truth, is no justice at all"

"The Florida Supreme Court was correct in allowing for a state-wide handcount of the ballots which the tabulating machines could not read. Furthermore, the Florida Supreme Court and other courts throughout Florida were correct in not providing standards for the handcount of the ballots. To have provided standards would have been acting in the scope of the legislature which would have been in violation of the United States Constitution, the United States Code, the Florida Constitution, and Florida statutory law.
The claim by Governor Bush the action by the Florida Supreme Court is in violation of the Fourteenth Amendment, or the Equal Protection Clause is absent merit and the United States Supreme Court should recognize this. The Florida statute provides ....a vote may be reasonably discerned...and though the statute lacks specificity, this is created by the Florida legislature and interpreted by the Florida Supreme Court. The Court must recognize Governor Bush has no inherent right to be President of the United States and the claim of violation of the Equal Protection Clause must fail.
Perhaps it is Vice-President Gore who should raise the issue of violation of the Fourteenth Amendment, Equal Protection Clause, and Due Process Clause. It is Vice-President Gore who is denied the assurances provided by Florida statute."

"It seems to me that to count all the votes without violating any laws and statues, all the county canvassing boards could via conference call, use their discretion by agreeing to adopt the method that was being used in the library to count the Miami-Dade votes after Judge Lewis's order. I voted for Bush, but like a lot of his supporters, I want all the votes counted, but fairly!! Could this not be the way?"

"I think the framers of our constitution would be very sad to watch thismess. The votes were counted as by national election laws, and recounted by Florida election laws, and recounted yet again!! And now they want to set a president of law suit after law suit to determine the outcome of an election. This country is supposed to be a constitutional republic, not a democracy. We do not need to change our election laws, only the quality of the people running for office. The electoral college was meant to keep a scoundrel out of office, and with GOD to help it may just do that. It should be noted that neither candidate was highly sought after, so perhaps some people didn't pick a candidate for president!!! All to often the law tries to deal with intent and not fact. If the cards were not punched clearly, so be it. "

"My thoughts on the presidential election is one of concern. What is really at stake with counting these votes. Over 43000 people turned out to vote and are being told their vote don't count. Is this the will of the people or the will of a political party that is afraid that they might lose the election. At this point, I feel that both parties should be working to settle this in a matter that will leave the American people feeling that the will of the people has been served. What happens when Al Gore wins with a recount; 50% of Americans feel he stole the election. What happens if no recount: 50% of America feels George Bush won on the 43000 voters. This is a no win situation that both Al Gore and George Bush has put this country in and it is a shame that the very people that want to serve us in this copacity CAN NOT work out a solution to bring us back together. At this point it doesn't matter who wins or loses this election, its what effect it will leave on us as a country."

" I am a 61 year old voter that has never seen a Republican or Democrat placed on a ballot either in New York (machine) or (Florida - IBM card) in what amounted to the THIRD POSITION! I was STUNNED that this butterfly ballot was deemed legal. I disagree that the manual recounting of the votes that were rejected as "NO VOTE" by machine counting would cause more irreparable harm to the loser in this election it would be an absolute travesty if the actual winner were to be declared the loser !! No matter who it may be. Let us not wait for the history books to say who really won in 2000"

"The U.S. Constitution gives specific dates as when certain things are mandated to be done. The dates are not to be changed unless by a constitutional amendment. The word shall is utilized as the final point. The Florida state constitution is patterned after the U.S. constitution as it must and shall follow such. If the U.S. constitution obliges strict adherence to dates how then can the Florida supreme court arbitrarily change the deadline of a specific date on its own volition. For that matter how can the Florida supreme court in essence usurp the power the constitution has given the Florida legislature. The U.S. constitution is the law of the land and it is absolute. The Florida supreme court is mandated by the U.S. constitution to see that dates are strictly enforced. as a matter of law. If there is a quarrel with an outcome it becomes easier to litigate it if the court follows the law. The present crisis has been precipitated because the court has taken matters into its own hands and has lost credibility as a legal entity. It did not enforce what it shall enforce."

"US Supreme Court: Please stop the insanity!!!!! How many times can you count and recount votes before the cards become spoiled? How can people interpret how another person INTENDED to vote? Through extrapolation as suggested?!!!!! This is nonsense and must be stopped. What about a good percentage of voters that were apathetic about the pres. choices and decided to vote locally only? Is it fair to vote for them? I think not. Machines have no bias. How many other states could change the total vote(popular vote) when all the absentee ballots are counted and added to the mix?"

"Why cant the Florida Legislature meet in emergency session and set a clear standard for counting the machine ballots in the manual recount. They could prohibit dimples and indentations from being counted as valid votes. If this were done, then the valid election result, which has already taken place will be confirmed."

"Thanks and congratulations to the Florida Supreme Court for restoring our faith in America! Millions of decent law abiding citizens have finally been represented. Just count the votes, period."

"How can you possibly expect people to determine how people would have vaoted based on a dimple? IT'S TOTAL INSANITY."

"Partisanship is to be expected with duly appointed Florida Supreme Court Justices. That is a given; it is the political way of life. However, one would think that, once attaining that high position, that your views would be fair and according to the law--not legislating new laws. No matter how much you sashay or sidestep, you cannot get around it. And the Supreme Court of the United States sent you a subtle warning...they even sent you a face-saving guideline; they were only softly slapping your hands. Do you realize the turmoil and the cost you have inflicted on the American people? This is absolutely ridiculous. As I understand, you are no longer appointed for an unspecified term--that the voters will now have a say on how long you stay on the bench. In fact, I believe that you were all voted in on this election--chads notwithstanding. I'm sure that you were all voted in as this a noninterest vote. Who cares about Supreme Court Justices? Duh? A "Swing Voter" who voted for Gore and very sorry for it."

"I do not understand why don't you (Supreme Court) clarify to the American people what you intend. This is not Fla. law anymore but U.S. law that you are "playing" with. I believe that politics is playing more of a role than you are willing to admit. Do you agree?"

"HOW DO I WRITE TO THE US SUPREME COURT ABOUT THEIR ILL-CONCEIVED OPINION DELIVERED TODAY? AREN'T THEY REACHABLE BY VOTERS BY E-MAIL??"

"The decision handed down today in the Gore lawsuit distresses me greatly. The Florida legislature had passed laws governing elections in your state. The laws were followed and twice the gods of the court have seen fit to overturn them and write new laws of their own liking after the election is over. How can laws be changed governing what has been finished? The election is not to be controlled by judges and if the U.S. Supreme court lets them get by with it, our country trully is down the toilet. They have NO jurisdiction. They have become nothing but hacks of the Democrat party and Albert "boo hoo they won't let me win" Gore. How dare they not only reverse the law but even the deadline they themselves set the last time they violated their constitutional authority? They would rather tear our beloved country apart for partisan gain than tell him to grow up. George H. W. Bush's wife told him on the day following the election to get over it and get on with his life. She has more intregrity than the entire Florida Supremes. They have totally destroyed my faith in the rule of law and I may never vote again. Why should I when a bunch of judges can overturn the rule of law for their own purposes?"

"I am not a law expert and respectfully suggest you made a huge mistake today by allowing the vote count to continue. I supported Gore but feel your actions will throw this Country into chaos. It seems to me that I read somewhere that the decision of law should be for the good of the majority of the population"

"How does George Bush justify tampering with Florida state's rights by asking the US Supreme Court to interfere with the Florida Supreme Court? It's hypocritical!"

"I would hope that this court would end this ridiculous facade, it is without a doubt been known on several occasions that George W. Bush has won this election so many times, to change it at this point would be absurd. Let's get on with governing this country."

"I am a 70 year old man and today I seen the most digusting miscarriage of justice I ever seen by the U.S.Supreme Court. If Bush prevails God help this country in the future. The Supreme will tell us who the next President will be from now on. Is this what we want as a democratic country? If I knew how to tell them I would."

"I think that the votes should not be counted. Voters should be responsible for making sure they vote accurately at the polls. Counting dimples and pimples is ridiculous. My vote is lost. America is lost."
